Terms and Conditions
All sales are final upon customer
placing their order(s). If a customer cancels an order
prior to Mozian & Associates, Inc. ("MAI") transmitting the UPC bar
code number(s), MAI may, at its sole discretion, elect to issue a
refund to customer minus a $ 9.95 administrative fee per bar
code. The UPC bar code number(s) MAI sells to you, may not
be transferred, resold or used for any other product(s) other than the
product(s) you specified in your order or in subsequent communications
with MAI taken place prior to MAI supplying the assigned number(s) to
you. Any such transfer, resale, or use of a UPC Bar Code
Number(s) for any other purpose but for that which was approved by MAI
prior to MAI supplying the assigned number(s) to you is prohibited
("Prohibited Use"). Any Prohibited Use or use of any UPC
Bar Code number(s) other than the ordered and supplied UPC Bar Code
Number(s) is illegal and may result in civil and criminal legal
proceedings against you. By purchasing a UPC Bar Code
Number(s) from MAI you hereby agree to the following: (i) to consent to
all civil legal proceedings being governed by the substantive
laws of New York State; (ii) to consent to the jurisdiction of any
federal or state court located in New York State; (iii) to waive any
objection based on lack of personal jurisdiction, improper venue, or
forum non conveniens; (iv) to waive of any and all rights to a trial by
jury; and (v) to pay all attorneys' fees and costs of MAI and its
successors and assigns, in enforcing the terms of this agreement.
